Buying as a foreigner

General information, not legal or tax advice. Confirm it with a notary before you sign.

Fideicomiso

This coast is inside Mexico’s restricted zone. A foreign individual generally cannot hold direct title to a residential property.

The usual path is a fideicomiso. A Mexican bank holds title and you are the beneficiary: you can use the property, rent it, and sell the beneficial rights. The term runs up to 50 years and can be renewed. The bank charges a setup fee and an annual fee. There is no single rate.

Closing costs

The deed is signed before a notary. The notary calculates the costs of that closing. They are not a percentage this page can set.

On the buyer’s side, people should expect the acquisition tax, which is not the same in Jalisco and in Nayarit, notary fees, the appraisal, and, when a trust is required, the bank’s setup. Who pays each line is written in the offer.

Taxes

Predial is the annual property tax, paid to the municipality. A fideicomiso adds the bank’s annual fee. Where there is a condo regime, that fee is not optional.

When you sell, income tax can apply to the gain and the notary withholds. Rent is taxable income in Mexico. This page does not estimate a yield.
